Terms and Conditions
Please read this agreement carefully. It sets out the terms under which The Posh Hats offers you use of its hats, fascinators, and hatinators. By renting a headpiece from The Posh Hats, you agree that you have read and accepted these terms and conditions, and they shall apply to your use.
These Agreements are made between You and The Posh Hats. Hat in this agreement is used in general to refer to hats, fascinators, and hatinators rented or sold by The Posh Hats.
The following terms and conditions apply:
1. Rental terms and conditions
1.a The hat(s) always remain the property of The Posh Hat.
1.b Due to the lighting effect in pictures, the colors of the hat(s) on the website may not be exact. Please contact us to verify the color.
1.c The full rental fee of the hat(s) is payable on reservation. These include the rental fee and the refundable deposit.
1.d Rental headpiece periods usually last for four days
1.e Once a hat has been taken for rental, it is considered a rental even if not worn and there will be no refund.
1.f The Posh Hats reserves the right to make substitutes without warning for any article that may be unavailable.
1.g The Posh Hats will not be liable for any delay or failure to deliver due to circumstances which are out of its control; or for any damage or injury caused by the use or misuse of the Company’s property.
1.h The liabilities of the renter commence at the time the rented hat(s) are delivered to a location agreed by The Posh Hats and continue until they are returned to The Posh Hats.
1.i Cancellation policy: The full rental fee will be refunded for cancellations made at least 24 hours before the rental date. The full rental fee will be retained for cancellations made less than 24 hours prior to the hire date.
1.j Rented hat(s) will be delivered at the agreed time and location (renter’s home or any other location agreed by The Posh Hats). Any delay caused by renter that exceeds a
15mins window would result in cancellation and loss of deposit.
2. Purchase Terms and Condition
2.a We do not guarantee that a purchased headpiece is brand new as most of our hats, fascinators, and hatinators are rented out. However, we do guarantee that all hats are professionally cleaned and sanitized before sold.
2.b All Hats, fascinators, and hatinators are shipped within 48hrs of purchase. Your item would be carefully packaged to avoid damage. We do not ship with the hat boxes on our website; however, we are pleased to include a hat box at an additional cost. Let us know if you want a hat box with your order.
2.c. Due to the lighting effect in pictures, the colors of the hat(s) on the website may not be exact. Please make room for that.
3. Billing
3.a When you rent a hat you will be required to provide The Posh Hats with valid, accurate, complete, and current PayPal or credit or debit card information that you are authorized to use.
3.b By signing up for the Service, you authorize The Posh Hats to bill your PayPal, credit, or debit card the applicable fees per-item or rental fees, shipping charges, and all applicable taxes, and any other charges you may incur in connection with your use of the Service.
3c If your hat is not returned on the due return date agreed when the purchase was made, The Posh Hats would charge your credit card for each overdue day, at the rate of $10 per day until the hat(s) is returned by the customer and The Posh Hats is notified by the shipping company or is picked up by The Posh Hats at an agreed location. In addition, The Posh Hats reserves the right to conclude you want to purchase the hat(s) in the event of an overdue return that exceeds 4days. That means you will forfeit your deposit.
3.d The Posh Hats may modify the price, content, or nature of the Service at any time. We may provide notice of any such changes by email, or by publishing them on the Site.
3.e Damage to property: If damage exceeds normal wear and tear, as determined by The Posh Hats in its sole discretion, you agree that The Posh Hats will either charge you for the full cost of replacing the hat as well as charge you the full amount of any lost earnings or incurred costs resulting from the damage or retain your deposit. The product replacement fee will vary depending on the specifics of each hat and its amount is to the full discretion of The Posh Hats.
3.f Customers are required to check their order carefully and ensure it’s in the correct condition before leaving The Posh Hats premises or staff members with the goods.
4. Hat care and hire responsibility
4.a Weather is the enemy of the hat(s). Please care for the rented hat and avoid the rain or any form of wetness. Always keep it under an umbrella when it is raining. The Posh Hats reserves the right to retain the full deposit if the item is returned marked or damaged in any way. This includes but is not limited to holes, dents, stains, and rain marks.
4.b Under no circumstances are customers to attempt to clean any hats themselves by any means. If so happens and results to any form of damage, The Posh Hats reserves the right to invoice for part or full replacement value of the items and charge you the full amount of any potential lost earnings or incurred costs regardless of whether any damage has been caused.
4.c If the hat is damaged beyond repair, lost, or stolen, then the full purchase price will be paid by the renter. The replacement cost will be determined by The Posh Hats.
4.d Should a previous renter not return a hat you have booked, or it is damaged, The Posh Hats will endeavor to find a good and suitable replacement. An exact replica style and color cannot be guaranteed.
4.e If the renter wants to return the hat(s) by mail, the hat(s) must be sent securely and insured to the value of the hat. Please do not tape directly to the hat box. Send a tracking number that shows that the hat(s) was mailed out on/before the return date.
4.f All original hat boxes must be returned with the rented hat(s). Customers will be charged $30 to cover the cost of replacing any hat boxes damaged or not returned.
